The Car or the Carletti? |

The Echo Early Music Festival (EEMF) is a project of the 501c3 exempt organization Keowee Chamber Music. The following rules govern this raffle: 1. The purchase price of a single raffle ticket is $20.00. Checks or money orders should be made payable to "Echo Early Music Festival" Payments are not tax deductible. If the bank dishonors an entrant's check or if any form of payment is returned unpaid or is not electronically authorized, the entry ticket will be declared invalid unless full payment is received prior to the drawing. All ticket sales are final and non-refundable. 2. Completed entries must be in the possession of EEMF before 9:00 PM on February 14, 2008 in order to be eligible for the drawing. Any tickets and payments turned in after the closure of the raffle will be returned to the entrants. 3. Winning ticket will be determined by random drawing, by a neutral party. Drawing date will be Thursday February 14th at Jack of the Wood Pub at 10:00 p.m.. The first name listed on the winning ticket shall be declared the winner of the drawing. Winners need not be present to win. Winners will be notified by telephone and mail. Should the winner be unreachable by all expedient means for a period of greater than 90 days after the drawing, an alternate winner shall be chosen. 4. The winner shall be the recipient, subject to the conditions below, of THEIR CHOICE of EITHER a 2008 Toyota Prius Hybrid automobile (‘vehicle’) or a 1938 Carlo Carletti violin (‘violin’), made available through Williams Gengakki violins, Atlanta, GA. Regardless of the number of tickets sold, the winner may elect the cash prize described in (7) below. 5. The delivery of the vehicle or violin shall be made available to the winner as soon as reasonable; subject to the availability of the prizes. Should either the violin or vehicle be practically unavailable at the time of the award, an alternative instrument or vehicle of comparable value will be awarded, in consultation with the winner. The winner is responsible for the transportation of the vehicle or the violin beyond Buncombe County, NC. 6. Winners will assume and be responsible for all licensing, registration, and all other fees, local, state and federal taxes, including and without limitation all applicable sales, use, withholding, luxury, income and special taxes. EEMF SPECIFICALLY DISCLAIMS ALL EXPRESSED OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE REGARDING THE AUTOMOBILE or VIOLIN. Ticket Buyer releases EEMF, Keowee Chamber Music, and their agents, from any liability whatsoever for any injuries, losses, or damages of any kind resulting from acceptance, possession, or use of any prizes, including potential tax treatment. 7. If 2,000 tickets are not sold by Thursday, February 14, 2008, at the time of the drawing, EEMF has the right to modify the prize structure such that: · The winner shall receive a monetary award (‘cash prize’) in the amount of the LESSER of 50% of the gross revenues of the contest, or $10,000, the maximum cash prize for a legal raffle in the state of North Carolina. 8.The decision of EEMF will be final in all matters pertaining to this raffle. 9. In order to elect the vehicle as a prize, a winner must be 18 years of age or older, and a licensed driver. Otherwise, the winner will be awarded their choice of either the violin or the Cash prize. 10. Void where prohibited or restricted by law. |
